Why Consider Mediation Instead Of Conventional Divorce Through The Connecticut Court System?

Divorce is one of the most stressful experiences that a person may ever have to deal with. In addition to facing the emotional trauma of separating a family unit, the process of dividing years of accumulated assets can be complicated and overwhelming. Divorce through Connecticut’s court system can take months, or even years, of timely court appearances and stressful meetings. Most people simply want to move on with their lives in a private, dignified manner.

A Mediator can work within two parties’ schedules to resolve a divorce in just one or two sessions. The Mediator acts as an impartial, neutral third party decision-maker, similar to the function of a trial judge. The difference is that couples have much more control over scheduling and privacy. Both spouses and their attorneys agree on the Mediator, hearing time and location. They also approve the rules and procedures ahead of time. The Mediator’s decision is binding, so appeals rarely become an issue down the road. The procedure can be completely confidential other than the final dissolution agreement which must be filed with the court.

Contrarily, the court system’s scheduling is arbitrary and unpredictable. Motions, hearings and trials are open for public consumption and scrutiny. Divorces usually expose some to the most intimate details of peoples’ personal lives and financial dealings. Most folks would want to shield themselves and their loved ones from such invasions.

Divorces involve many complex issues, especially the division of financial assets, products and instruments which makes it critical that a Mediator have a sophisticated understanding not only marital law, but also many other important and applicable areas of law. It is also essential that the Mediator understands how to negotiate and mediate. As a divorce lawyer for almost thirty years and a veteran in the Connecticut court system, Attorney Jeffrey Hill has vast experience in all of these areas.
